TERMS & CONDITIONS OF SERVICE:

Please read carefully and be sure you understand these Terms & Conditions prior to registering for any Sarah Joanna Fitness program. Your purchase and use of my services implies you’ve read and accepted the below Terms & Conditions. These terms may change under my discretion at any time and without prior notice given.

 

  1. INFORMATION
  1. Your agreement is with your personal trainer at Sarah Joanna Fitness (Sarah Gourlay) who delivers your training.
  2. The booking terms and conditions set out below and the general information contained on our website, documentation and all correspondence apply to all bookings with SARAH JOANNA FITNESS (“SJFITNESS and/or “We” and/or “Us”).
    1. Updated terms may be issues from time-to-time but any changes will only be valid if SARAH JOANNA FITNESS confirms in writing
    2. The information contained on our website and all other correspondence is correct to the best of our knowledge. 
  1. TRAINER
  1. Sarah is a fully qualified personal trainer and specialised pre and postnatal coach (Accredited via Active IQ)
  1. TRAINER’S OBLIGATIONS
  1. Sarah will use her skills and knowledge to design a safe exercise program and will include exercises that can be modified if required to suit client’s abilities
  2. You understand the results of any fitness program are not guaranteed. Your progress depends on your 100% effort and commitment to the program. In particular, you acknowledge that individual results may vary and no particular result is guaranteed by Sarah
  3. All client information is kept strictly private and confidential 
  1. YOUR OBLIGATIONS
  1. All information given by SJFITNESS inc. under Sarah Gourlay is not a medical doctor, information given is via an education in physical education & nutrition.
  2. Information given are recommendations and advice, thus should not be taken as medical advice. They do not state to cure or intend to cure medical issues/problems. 
  3. Recommendations made by SJFitness do not replace advice of doctors or said professionals. Please consult a physician or health professional for further issues.
  4. It’s understood between you and Sarah that both must commit to your training and/or nutrition program 100% in order for you to achieve results
  5. You’re required to complete a Physical Activity Readiness Questionnaire (PAR-Q) before you’ll receive your training and/or nutrition program
  6. It’s your responsibility to inform Sarah of any conditions or changes to your health, no and ongoing that might affect your ability to exercise safely and with minimal risk of injury
  7. Sarah may require a letter of ‘medical clearance’ from your GP, Women’s Health Physio or other medical/health professional and you must provide details if any further medical information is requested from a practitioner
  8. You understand there are inherent risks in participating in a program of strenuous exercise. If you sustain or claim to have sustained any injury while participating in training, you acknowledge Sarah is NOT responsible, except where the injury was caused by her gross negligence or intentional act
  9. Sarah cannot be held liable in any way for undeclared or unknown medical conditions
  1. PAYMENTS
  1. No refunds on ALL training services unless medical certification is able to be shown which prevents continuing said programming.
  2. No refunds on ALL services, 2 week cancellation of service minimum AFTER a minimum 12 week commitment on all online services..
  3. Payments must be made via direct debit or prior to all personal training services minimum 1 week and on going and a minimum of a 12 week commitment.
  4. Failure to make payment or failed payments may incur a delayed payment fee and or services ceased
  5. A minimum of 2 weeks notice needs to be given for ceasing a coaching service and or if you are going away or freezing your coaching 2 weeks needs to be given to hold payments. 
  6. Refunds will not be given at any time,  you may FREEZE your coaching services for extenuating situations for up to 2 months with Sarah’s discretion.
  7. If you are completing personal training services any cancellations under 48 hours will be required to be paid in full if you cannot attend or now show. Appointments can be rescheduled outside of the 48 hour cancellation policy within the week. Medical certification will condone no payment on the session but notice still needs to be given. 
  8. All cancellations and rebookings on services must be done so via EMAIL or PHONE/TEXT only within standard business hours.
  9. All of the above applies to not only head coach Sarah Gourlay but all affiliated trainers and coaches under SJFitness
  10. It is the client’s responsibility to uphold their client agreement and meet check in times/dates and not the coaches
  1. HEALTH AND SAFETY
  1. Sarah holds a current emergency workplace first aid certification accredited by St John.
  1. WARRANTIES (BY CLIENTS)
  1. You represent and warrant to Sarah Joanna Fitness that:
    1. you are 18 years old or above;
    2. you’ve sought and obtained advice from your medical practitioner before commencing any Program or following and meal plan or nutrition guide supplied by us;
    3. all information and documentation provided to Sarah Joanna Fitness from time to time is accurate and not misleading in any respect;
    4. you will be responsible for the management of any food allergies or intolerances;
    5. you will exercise in a place which is safe and suitable for the Program; and 
    6. you will abide by these terms and conditions at all times
  1. LIABILITY
  1. Sarah is not liable for any loss or injury attributed to:
    1. The Client’s fault
    2. Events which Sarah couldn’t have foreseen, even if they’d taken reasonable care
    3. Sarah isn’t liable if you ignore her recommendation, at any stage, to seek medical advice
  1. INTELLECTUAL PROPERTY
  1. Any marketing, educational or other materials, including SARAH JOANNA FITNESS programs and/or other variations and its nutrition services made available to you will at all times be subject to copyright
  2. You undertake to use such materials only for your personal development and not to copy, publish or reproduce such materials
  3. All training programs and nutritional guidelines are designed for you personally and thus not to be shown on any social platforms. Any Intellectual property of SJFITNESS  seen on social platforms or shared verbally or physically may face legal action.
  1. GENERAL
  1. SARAH JOANNA FITNESS has the right to change these Terms and Conditions. 
  2. You are responsible for keeping all your contact information and marketing preferences up to date with your trainer. In order to comply with the Data Protection Act 1998, Sarah will only do what you ask her to do or what you’ve given her permission to do with any personal or sensitive information held about you
